Capias is an order issued by a Court to take an individual into custody. It is generally issued when a litigant fails to appear for a court hearing or trial.

Warrant is a legal document issued by a judge authorizing the search of a place and seizure of specified items found there (search warrant), or the arrest or detention of a specified person (arrest warrant). No hearing is required and the person need not be notified, but the Court must be given probable or reasonable cause to believe that the warrant is necessary for apprehension before it issues a warrant. Affidavits are frequently used in establishing this probable or reasonable cause.

Writ is an order issued by a Court commanding that a certain act or acts be done or not done.

When a capias is issued out of Delaware State Court, the suject shall be brought before the Court immediately if in session; otherwise, in default of specified bond, the subect shall be detained in a facility of the Department of Corrections/Services to Children, Youth and Their Families for appearance in this Court at its next session.

Delaware is located in the northeastern portion of the Delmarva Peninsula and is the 6th most densely populated of the 50 United States. Delaware is divided into three counties. These three counties are New Castle, Kent, and Sussex. While the southern two counties have historically been predominantly agricultural, New Castle County has been more industrialized.

The Delaware General Assembly consists of a House of Representatives with 41 members and a Senate with 21 members. It sits in Dover, the state capital. Representatives are elected to two-year terms, while senators are elected to four-year terms.



Laws of Delaware

The Laws of Delaware are a compilation of the official acts of each session of the Delaware General Assembly. Each session lasts for two years. After legislation passes the House of Representatives and the Senate, in identical form, it is sent to the Governor. When the legislation is signed by the Governor, it is assigned a chapter number unique to the current volume of the Laws of Delaware.
